1. GENERAL PROVISIONS
1.1. This Public Offer Agreement (hereinafter referred to as the “Agreement”) is an official and public offer of Individual Entrepreneur Maiatska Liana Serhiivna, Tax ID 3675100588, hereinafter referred to as the “Seller”, to provide digital products and consulting services in the field of design under the terms described below.
1.2. Any individual or legal entity (hereinafter referred to as the “Customer”) who makes a payment for a digital product or service through the website https://itsadesignspace.framer.website is deemed to have fully accepted the terms of this Agreement.
Such acceptance constitutes a legally binding contract between the Parties.
1.3. This Agreement governs the relationship between the Seller and the Customer regarding the purchase of digital templates and related services.
1.4. By accepting this Agreement, the Customer confirms that they are of legal age, have full legal capacity, and are entitled to enter into this Agreement.
2. TERMS AND DEFINITIONS
2.1. Website — https://itsadesignspace.framer.website, the official online platform of the Seller for the sale of digital templates and related design services.
2.2. Digital Product / Template — a downloadable digital file, including but not limited to design layouts, UI kits, components, or other creative assets created and owned by the Seller.
2.3. Services — consulting, communication, or design support provided by the Seller in addition to the purchase of digital products.
2.4. Acceptance of the Offer — full and unconditional acceptance by the Customer of the terms of this Agreement through payment on the Website.
3. SUBJECT OF THE AGREEMENT
3.1. The Seller agrees to provide the Customer with access to purchased digital templates and/or consulting services as described on the Website.
3.2. Payment is processed via the WayForPay payment system using Visa, MasterCard, or other supported methods.
3.3. Upon successful payment, the Customer receives access to the purchased digital content via an automatic download link or email.
3.4. All products are provided in digital format only. No physical delivery is carried out.
3.5. Since digital products cannot be “returned” after download, all purchases are final and non-refundable.
4. PRICING AND PAYMENT TERMS
4.1. All prices on the Website are listed in US dollars (USD) and include all applicable taxes unless otherwise specified.
4.2. The Seller reserves the right to change prices, availability, or product details without prior notice.
4.3. Payment is processed via the international payment system WayForPay.
By completing a payment, the Customer agrees to the WayForPay payment terms and privacy policy.
4.4. The Customer is responsible for any additional charges from their bank or payment provider, including currency conversion fees.
4.5. The Customer must verify all payment information before submitting.
The Seller is not responsible for failed transactions due to Customer errors or third-party payment issues.
5. RIGHTS AND OBLIGATIONS OF THE PARTIES
The Seller agrees to:
Provide purchased digital products in proper technical quality.
Ensure confidentiality of Customer and payment data.
Provide reasonable support regarding access or technical issues.
The Seller has the right to:
Modify or update content, pricing, or Website functionality without prior notice.
Suspend or restrict Customer access in case of copyright violations or misuse.
The Customer agrees to:
Use digital templates only in accordance with the granted license.
Not distribute, sell, or share purchased files with third parties.
Comply with applicable copyright laws in their country.
The Customer has the right to:
Use purchased products within the limits of the provided license.
Contact the Seller for technical or consultation support using the contact information provided on the Website.
6. INTELLECTUAL PROPERTY AND LICENSE TERMS
6.1. All materials on the Website — including digital templates, images, text, code, and layouts — are the exclusive intellectual property of the Seller.
6.2. The Customer is granted a non-exclusive, non-transferable, worldwide license to use purchased templates for personal or commercial purposes in accordance with the terms specified on the Website.
6.4. Violation of these terms constitutes a breach of this Agreement and may result in license termination and legal action.
7. LIMITATION OF LIABILITY
7.1. The Seller shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use purchased products.
7.2. The Seller does not guarantee compatibility of templates with all software versions or devices, unless otherwise stated in the product description.
7.3. The Seller’s total liability in any case shall not exceed the amount paid by the Customer for the respective product.
8. PERSONAL DATA AND CONFIDENTIALITY
8.1. The Seller processes Customer data in compliance with international data protection standards, including the General Data Protection Regulation (GDPR).
8.2. Personal data (name, email, payment details) is used solely for order processing and communication with the Customer.
8.3. The Seller does not share personal data with third parties, except when necessary to complete a transaction or as required by law.
